(CBS/AP) President Obama's health care law overcame a major legal hurdle Tuesday, as an appeals court upheld the controversial law's constitutionality. The U.S. Court of Appeals for the District of Columbia upheld the lower court's ruling that found Congress did not overstep its authority in requiring people to have insurance or pay a penalty, beginning in 2014. PICTURES: Health insurance horror stories The requirement is the most controversial of Obama's signature domestic legislative achievement and the focus of conflicting opinions from judges nationwide. The Supreme Court could decide as early as Thursday during a closed meeting whether to accept appeals from some of those earlier rulings. The ruling in Washington grew out of a lawsuit brought by evangelist Pat Robertson's legal group, the American Center for Law and Justice. The group claimed that the insurance mandate is unconstitutional because it forces Americans to buy a product. It also violates the religious freedom of those … [Read more...] about CBS News Logo Appeals court backs Obama health care law: What comes next?

(CBS News) Beginning today, up to 47 million women may be eligible to get free access to preventive health care services as that provision of President Barack Obama's Affordable Care Act goes into effect. As contraception mandate goes into effect, opponents continue to fight "Women deserve to have control over their health care," wrote Department of Health and Human Services (HHS) Secretary Kathleen Sebelius on a blog post on Healthcare.gov. "Too often, they have gone without preventive services, worrying about what even a $20 insurance co-pay would mean to their families' budgets and choosing to pay for groceries or rent instead. But now, thanks to the health care law, many women won't have to make that choice." Under the new provision that goes into effect August 1, 2012, women will be eligible to receive the following eight services without paying a co-pay: Well-woman visits, including an annual check-up for adult women to get recommended preventive services, and additional visits … [Read more...] about CBS News Logo Free contraception for women provision of Obama health care law starts today
WASHINGTON -- The House defied a White House veto threatand voted Thursday to abolish a tax on medical device makers as a group of Democrats uncharacteristically joined Republicans in moving to kill part of President Barack Obama's health care law. Thursday's 280-140 House vote was exactly the two-thirds margin that supporters would need to override a presidential veto. The real suspense will come in the Senate, which voted overwhelmingly to repeal the levy in 2013, but in a nonbinding roll call lacking the political pressures of a veto showdown. The Republican-led House has voted more than 50 times since 2011 to void all or part of Obama's health care overhaul, usually along party lines. On Thursday, Republicans were joined by 46 Democrats from states where medical devices are made to erase the 2.3 percent tax. House Majority Leader Kevin McCarthy, R-Calif., said he hoped the bill's bipartisan support "will make the president reconsider." The vote came as lawmakers prepare for a … [Read more...] about CBS News Logo House votes to kill health care law’s medical device tax
WASHINGTON -- Protecting his signature domestic achievement, President Barack Obama on Friday vetoed legislation to repeal his health care law, saying the measure "would reverse the significant progress we have made in improving health care in America." Republican lawmakers have pushed many repeal measures since 2010, when Obama signed the health care program into law. This was the first of those bills to clear Congress and reach his desk. Republicans have argued that the law doesn't work and promised to override the veto next year. "It's no surprise that someone named Obama vetoed a bill repealing Obamacare," House Speaker Paul Ryan, R-Wisconsin, said in a video released Friday. "This law will collapse under its own weight or it will be repealed...Next year, if we're sending this bill to a Republican president, it will get signed into law. Obamacare will be gone." In his veto message to Congress, Obama disagreed. Obama said the Affordable Care Act includes fairer rules and stronger … [Read more...] about CBS News Logo Obama vetoes bill to repeal signature health care law
Former President Bill Clinton criticized the Affordable Care Act at a campaign event Monday, saying the way President Obama’s signature legislative accomplishment works in practice is “the craziest thing in the world.” “You’ve got this crazy system where all of a sudden 25 million more people have healthcare and then the people are out there busting it sometimes 60 hours a week wind up with their premiums doubled and their coverage cut in half,” he said in Flint, Mich. “It’s the craziest thing in the world.” Still, Clinton said repealing the Affordable Care Act—as Republican nominee Donald Trump wants to do—isn’t the answer. “We’ve got to figure out what to do now on healthcare. [Hillary Clinton’s] opponent said, ‘Oh, just repeal it all, the market will take care of it,’” he said. “That didn’t work out very well for us, did it? We wound up with the most expensive … [Read more...] about CBS News Logo Bill Clinton calls Obama health care law a “crazy system”
