In the weeks after George Floyd’s murder, protesters in Denver demanded the prosecution and conviction of the Minneapolis officer responsible for his death as well as the prosecution of officers who kill people in Colorado. On Tuesday, a Minnesota jury found the Minneapolis police officer guilty of murdering Floyd — a result Colorado leaders said was a small step toward improving police accountability . But criminal charges against Colorado law enforcement officers who kill people while on-duty remain rare and convictions are even rarer. There is no official historical database of officers who have been charged or convicted of on-duty killings, but a review of Denver Post archives from the past 10 years found at least five cases where officers were charged. According to reports, a hearing for Masterson's criminal case was held on Wednesday, where his attorney, Tom Mesereau, alleged to the judge, "This is a high profile case and we think that information has been leaked to the press." The Daily Mail reports that Mesereau suggested the leaks may have come from cops or the Los Angeles District Attorney's office. Defense lawyers have a saying: “If the law is against you, pound on the facts; if the facts are against you, pound on the table.” For military defense lawyers, there is a slight modification: “Before you pound on the table, pound on the chain of command.” Why? Because in the military, leaders are accountable for the failures of their subordinates and military juries are the harshest critics of their colleagues whose leadership failures contribute to misconduct. Indeed, the Vanessa Guillen disappearance at Fort Hood, Texas, and its subsequent fallout, is a prime and recent example of how failures at low levels of the military result in accountability at high levels.
