By Stephen Nellis and Adam JourdanSAN FRANCISCO/SHANGHAI (Reuters) - A Chinese court has ordered a sales ban of some older Apple Inc iPhone models in China for violating two patents of chipmaker Qualcomm Inc, though intellectual property lawyers said enforcement of the ban was likely still a distant threat.The case, brought by Qualcomm, is part of a global patent dispute between the two U.S. companies that includes dozens of lawsuits. It creates uncertainty over Apple's business in one of its biggest markets at a time when concerns over waning demand for new iPhones are battering its shares.Apple said on Monday that all of its phone models remained on sale in mainland China and that it had filed a request for reconsideration with the court, the first step in a long appeal process that could end up at China's Supreme Court. Ian King Bloomberg News Published 4:23 PM EST Dec 10, 2018 Qualcomm Inc. said it won a ruling in China against Apple Inc. that bans the sale of several iPhone models in that country. The Fuzhou Intermediate People’s Court ruled that Apple is infringing two Qualcomm patents and issued injunctions against the sale of the iPhone 6S, iPhone 6S Plus, iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus and iPhone X, the San Diego, California-based chipmaker said in a statement Monday. The most recent models introduced in September, the iPhone XS, XR and XS Max, are not covered by the ban. The ruling could potentially affect iPhone sales in the world’s biggest market for smartphones, where the company generates about a fifth of its revenue, and comes at time when demand for Apple’s most important product is slowing. Appeals Court Rules Sale Of Ooltewah Woman’s Home At Back Tax Sale Be Voided Because She Did Not Get Proper Notice
The Tennessee Court of Appeals has ruled that a woman whose Ooltewah home was sold at a back tax sale without her knowledge should get title to the house back. Chancellor Pam Fleenor had dismissed a suit filed by Linda Owens. However, the Appeals Court directed the chancellor to declare the sale of the property to Kenneth Stiner Sr. void. The Appeals Court said Ms. Owens never received proper notice from the county that her house was being sold for unpaid back taxes. Ms. Owens said the first she learned about the sale was when the new "owner" showed up at her house. He had bought the substantial house at 9210 Dexter Lane for $42,000. The Appeals Court noted that the county never sent a notice to 9210 Dexter Lane, but to other nearby addresses - mainly to a vacant lot. Court Rules Sale of Parks, Removal of Confederate Statues Was Legal
click to enlarge Minutes before Nathan Bedford Forrest's statue was removed from Health Sciences Park A Davidson County Chancery Court ruled Wednesday that Memphis' sale of two Downtown parks and nonprofit Memphis Greenspace's removal of three Confederate monuments was legal, dismissing a lawsuit initiated by the Sons of Confederate Veterans (SCV) Forrest Camp. SCV Forrest Camp filed a lawsuit against Greenspace and the city of Memphis, asserting that the removal of the monuments violated state law, however Greenspace and the city maintain that the move was legal because the parks were sold before the statues were taken down. Chancellor Ellen Hobbs Lyle agreed, saying that the 2016 version of the Tennessee Heritage Protection Act doesn’t prohibit the sale of parks containing monuments. “The conveyance was legal and valid.” SCV also asked the court to issue an injunction, prohibiting Greenspace from relocating or selling the statues.
