Bill Coley, FBI agents and others is barely a month old, but a magistrate recommends dismissing all claims filed by imprisoned Dynus executive Orlando Carter.United States Magistrate Judge Stephanie K. Bowman has halted all further briefings in the 35-day old case and recommended all claims be dismissed. She stated she was reviewing the lawsuit to determine if it should “be dismissed because it is frivolous, malicious, fails to state a claim upon which relief may be granted or seeks monetary relief from a defendant who is immune from such relief.”Carter filed the lawsuit from the federal prison in Ashland, Ky., on June 7. Callahan, Staff Writer BUTLER COUNTY — Butler County sued 20 major drug companies and distributors for $5 million last year, hoping to be part of a global solution to eradicate the opioid epidemic, and now the county is officially part of the larger fight.Butler County’s lawsuit — filed in the federal court in November — has been folded into what is known as multidistrict litigation (MDL), a tool used to consolidate similar actions, reduce duplication of efforts, and facilitate a quicker disposition of the cases. In this case the hope is that the hundreds of actions brought against giant drug companies will produce a settlement.The federal judge handling the MDL, Judge Dan Aaron Polster in the Northern District Court of Ohio, has not minced words describing the current state of affairs. By Lauren Pack, Staff Writer BUTLER COUNTY — At the age of 67, David Kash is trading the suits he donned daily in the courtroom for a more casual look on the golf course and in the yard of his Middletown home.Kash will retire at the end of this month after 17 years as Assistant Butler County Prosecutor and 21 years in private practice.Last month, Kash tried his last case with fellow Assistant Prosecutor Kelly Heile that ended with the conviction of one of three men in an Oxford rape case. On Friday, he was in the courtroom for the sentencing of the trio, marking one of his last appearances as a prosecutor.
