Some Jan. 6 defendants try to use journalism as U.S. Capitol riot defense
The Trump supporters who stormed the U.S. Capitol in January created a trove of self-incriminating evidence, thoroughly documenting their actions and words in videos and social media posts. Now some of the camera-toting people in the crowd are claiming they were only there to record history as journalists, not to join a deadly insurrection. It’s unlikely that any of the self-proclaimed journalists can mount a viable defense on the First Amendment’s free speech grounds, experts say. They face long odds if video captured them acting more like rioters than impartial observers. But as the internet has broadened and blurred the definition of a journalist, some appear intent on trying. At least eight defendants charged in the Jan. 6 riot have identified themselves as a journalist or a documentary filmmaker, including three people arrested this month, according to an Associated Press review of court records in nearly 400 federal cases. The insurrection led to the deaths of five people, … [Read more...] about Some Jan. 6 defendants try to use journalism as U.S. Capitol riot defense
Minneapolis Officer Declines to Testify in His Defense in Floyd Case
WASHINGTON - Former Minneapolis police officer Derek Chauvin invoked his constitutional right against self-incrimination Thursday and did not testify in his defense in the death last year of a Black man, George Floyd, whom Chauvin pinned down on a city street by pressing his knee on Floyd’s neck for more than nine minutes. Chauvin, 45, is facing murder and manslaughter charges in the high-profile case that triggered worldwide protests against police abuse of minorities. He told trial Judge Peter Cahill he had extensively discussed whether to testify with his attorney, Eric Nelson, but decided on his own not to. He accepted Cahill’s offer to read a standard legal instruction to the 12-member jury that it should not draw any implication from Chauvin’s decision not to testify. Defense rests The defense wrapped up its case Thursday shortly after Chauvin expressed his decision. It was the first time that Chauvin, who is white and was a 19-year veteran of the Minneapolis police … [Read more...] about Minneapolis Officer Declines to Testify in His Defense in Floyd Case
Prosecution, Defense Present Closing Arguments in Derek Chauvin Trial
The prosecution and defense gave their closing arguments Monday in a Hennepin County courtroom in the trial of former Minneapolis, Minnesota, police officer Derek Chauvin in the death of George Floyd last May. Judge Peter A. Cahill delivered his instructions to the jury, then allowed the prosecution to proceed. Steve Schleicher, appointed to the case by Minnesota Attorney General Keith Ellison, delivered an emotional presentation, arguing that Chauvin had ignored his police training, as well as Floyd’s desperate pleas for air, as he knelt on his neck and caused his death. Defense attorney Eric Nelson attempted to pick apart the prosecution’s case, element by element. He reminded the jury that Chauvin began with a presumption of innocence, and reminded them that the prosecution had to prove its case beyond a reasonable doubt — a standard that CNN senior legal analyst Laura Coates suggested was a hint of weakness in Chauvin’s defense. Defense begins the closing by defining … [Read more...] about Prosecution, Defense Present Closing Arguments in Derek Chauvin Trial
Derek Chauvin trial judge slams Maxine Waters’ inflammatory comments
close Video Former prosecutor: Expect Chauvin jury to 'sit back,' show case 'respect it deserves' Criminal defense attorney Mark Eiglarsh discusses closing arguments in the Minneapolis murder trial on 'The Story' A lawyer defending Derek Chauvin, who is on trial for the death of George Floyd, cited Rep. Maxine Waters’, D-Calif., comments to Minnesota protesters over the weekend in court on Monday. "And now that we have [a] U.S. representative … threatening acts of violence in relation to this specific case, it's it's mind boggling to me to have," Attorney Eric Nelson said, as he attempted to argue that the jury may have been unduly influenced by external factors. Judge Peter Cahill said that he wished elected officials would stop referencing the case "especially in a manner that is disrespectful to the rule of law" so as to let the judicial process play out as intended. He added, however, that he did not believe the comments unduly influenced … [Read more...] about Derek Chauvin trial judge slams Maxine Waters’ inflammatory comments
